Terms of Service

1. Overview
Welcome to Sabarat.
These Terms of Service govern your access to and use of the Sabarat website, booking platform, customer account features, and all related services provided by or through Sabarat (collectively, the "Services").
The terms "Sabarat," "we," "us," and "our" refer to the operator of the Sabarat platform, based in Marrakech, Morocco.
By visiting the website, creating an account, submitting a booking request, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
These Terms should be read together with our Privacy Policy and Refund and Cancellation Policy, which form part of the legal framework governing your use of Sabarat.
2. Services overview
Sabarat is an adventure and experiences booking marketplace. We connect travelers with operators who provide outdoor activities, desert camps, guided treks, aerial experiences, water activities, cultural excursions, and other curated adventures across Morocco.
Sabarat facilitates the booking process. We are not an Operator and do not personally conduct the experiences. Operators are independent parties who accept booking requests and deliver experiences according to the confirmed booking details and their own operational requirements.
3. Eligibility
To use the Services, you must:
- be at least 18 years old, or have the legal capacity to enter a binding agreement under applicable law;
- have the authority to agree to these Terms on behalf of any person whose information you submit;
- provide accurate and complete information;
- comply with all applicable laws; and
- not be prohibited from using the Services under these Terms or applicable law.
Where a booking involves a minor, the adult making the booking confirms that they are a parent or legal guardian authorized to consent on the minor's behalf.
4. Accounts
Creating an account allows you to manage bookings, track status, save preferences, and access the partner program.
You are responsible for:
- keeping your login credentials secure;
- all activity occurring under your account;
- promptly notifying us of any unauthorized use or security breach; and
- ensuring that your account information remains accurate and current.
Do not share your account credentials with another person. Sabarat is not liable for loss or harm caused by unauthorized account access where you did not notify us promptly.
Sabarat may suspend or permanently close an account where there is evidence of a violation of these Terms, fraudulent activity, security risk, or misuse.
5. Booking process
5.1 Booking requests
Submitting a booking request means you are asking to reserve a listed experience. A request does not guarantee availability and is not a confirmed booking until Sabarat issues written or electronic confirmation.
Sabarat may reject a request where the experience is unavailable, the information provided is incomplete or inaccurate, an activity-specific eligibility requirement is not met, or for another lawful reason.
Where a request is rejected before confirmation, no experience fee is due for that request.
5.2 Booking confirmation
A booking is confirmed when Sabarat sends a confirmation email or message to the contact details you provided.
At confirmation, you agree to:
- attend at the confirmed time, date, and pickup or meeting location;
- comply with all activity requirements, safety instructions, and Operator rules;
- provide accurate participant details and communicate relevant changes promptly; and
- review and meet the eligibility, equipment, and preparation requirements described in the listing.
5.3 Booking reference
Every confirmed booking receives a unique booking reference. Keep this reference available when communicating with Sabarat or an Operator.
6. Operators
6.1 Operator responsibility
Operators are responsible for the safe and professional delivery of their experiences, including:
- safety equipment and briefings;
- qualified staff and supervision;
- complying with applicable safety, licensing, and insurance requirements;
- communicating material changes to Sabarat promptly; and
- treating customers respectfully and professionally.
6.2 Operator conduct standards
Operators connected with Sabarat must not:
- make unauthorized charges;
- misrepresent experience content or safety;
- discriminate unlawfully;
- solicit direct bookings to bypass Sabarat; or
- otherwise act in a way that harms customers or violates applicable law.
6.3 Operator independence
Operators are independent parties. Sabarat does not control their day-to-day operations, staffing, or equipment choices. However, Sabarat expects Operators to maintain standards consistent with their listing descriptions, their accepted bookings, and applicable law.
7. Activity requirements and safety
Many activities have specific eligibility requirements. These are described in each listing and may include:
- minimum or maximum age;
- weight or height limits;
- absence of pregnancy;
- absence of certain medical conditions, recent injuries, or surgery;
- physical fitness level;
- sobriety requirements;
- required identification, clothing, or footwear;
- guardian consent for minors; and
- other activity-specific conditions.
You are responsible for reading, understanding, and truthfully complying with all requirements before booking and attending. Providing false information to meet an eligibility requirement puts yourself and others at risk and may result in refusal to participate, no refund, and account suspension.
If an Operator refuses participation because a disclosed requirement was not met, the booking is not refundable. See the Refund and Cancellation Policy for details.
8. Customer conduct
When using the Services, you agree to:
- provide accurate and honest information;
- treat Operators, staff, guides, pilots, drivers, instructors, and other participants with respect;
- follow all safety instructions and Operator rules;
- arrive at the confirmed time and location;
- not attend under the influence of alcohol or prohibited substances where the activity requires sobriety;
- not behave in a dangerous, abusive, or disruptive manner; and
- comply with applicable Moroccan law and the laws of any location where an activity takes place.
Sabarat reserves the right to refuse or cancel a booking, restrict or terminate an account, or take other action where a customer engages in prohibited conduct.
9. Pricing and payment
9.1 Pricing
Sabarat lists experience prices in Moroccan Dirham (MAD) unless stated otherwise. Displayed prices are subject to change. The price applicable to a booking is confirmed at the time of booking confirmation.
Sabarat does not guarantee that a listed price reflects the total cost of independent travel arrangements not included in the experience.
9.2 Payment methods
Sabarat may offer various payment methods, including online payment at booking, cash payment to the Operator, or other methods disclosed at the time of booking. The available methods will be presented during the booking process.
9.3 Fees
Sabarat may charge a reservation fee, service fee, platform fee, or deposit. Any such fee will be disclosed before payment. See the Refund and Cancellation Policy regarding refundability.
9.4 No hidden charges
An Operator may not charge a customer for costs not disclosed in the listing or in the booking confirmation, unless the charge is directly and reasonably connected with a customer-caused cost and was fairly disclosed before the customer accepted it.
10. Cancellations, rescheduling, and refunds
Cancellation, rescheduling, and refund rights are governed by the Refund and Cancellation Policy, which forms part of these Terms.
Key points:
- Eligible cancellations require a request received more than 24 hours before the scheduled start time.
- Late cancellations, no-shows, and customer-caused ineligibility are not refundable.
- Weather cancellations and Operator emergencies give rise to rescheduling or, where rescheduling is not possible, a refund.
- Refunds are generally processed within 24 hours to seven calendar days after approval.
Nothing in the Refund and Cancellation Policy limits a mandatory consumer right available under applicable Moroccan law.
11. Reviews and customer content
11.1 Submitting reviews
Sabarat may allow customers who have completed a booking to submit written reviews, ratings, and photographs. By submitting a review, you confirm that:
- you completed or participated in the relevant experience;
- the review is honest and based on your genuine experience;
- the content does not contain false factual claims, harassing, defamatory, discriminatory, sexually explicit, or illegal material;
- the content does not contain the personal information of others without authorization; and
- you own or have permission to submit any photograph included.
11.2 License to use content
By submitting a review, photograph, rating, or other content ("Customer Content"), you grant Sabarat a non-exclusive, royalty-free, sublicensable, perpetual, worldwide license to use, reproduce, display, distribute, translate, and publish the Customer Content in connection with the Services, marketing, and promotion of Sabarat and its listed experiences.
This license does not transfer ownership of your content. You retain ownership and responsibility for the content you submit.
11.3 Translations and corrections
Sabarat may translate Customer Content into other languages and make minor formatting corrections. Sabarat will not intentionally change the meaning of your review.
11.4 Content we may remove
Sabarat may remove or decline to publish Customer Content that violates these Terms, contains false or misleading information, harms Operator reputation without factual basis, violates applicable law, or is otherwise inappropriate.
Sabarat is not obligated to publish every review submitted.
11.5 Review integrity
Manipulating reviews, submitting false reviews, incentivizing or pressuring others to submit reviews, or submitting reviews on behalf of others without genuine personal experience is prohibited and may result in account suspension and legal action.
12. Intellectual property
12.1 Our content
All text, photographs, graphics, video, audio, software, code, design, branding, trademarks, and other content appearing on or forming part of the Sabarat platform (excluding Customer Content and Operator-provided listing content) is owned by or licensed to Sabarat and protected by applicable intellectual property law.
12.2 Permitted personal use
Subject to compliance with these Terms, Sabarat grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial booking purposes.
12.3 Restrictions
You must not:
- copy, reproduce, modify, adapt, translate, distribute, publicly display, or create derivative works of platform content without written permission;
- use automated scraping, crawling, or data-extraction tools;
- use the Services for commercial or re-selling purposes without authorization;
- reverse-engineer or decompile any part of the platform; or
- remove or alter any intellectual property notice.
13. Prohibited uses
You must not use the Services to:
- submit false, misleading, or fraudulent information;
- impersonate another person or entity;
- access another user's account without authorization;
- attempt to circumvent security measures;
- disrupt or degrade the performance of the platform;
- transmit spam, malware, or unauthorized communications;
- engage in unauthorized commercial activity;
- collect or harvest personal information without authorization; or
- violate applicable law.
14. Complaint and support process
If you have a complaint about a booking, an Operator, a refund, or the Services, please submit it through:
- the complaints form at https://sabarat.com/complaints; or
- email to support@sabarat.com.
Include your booking reference, a description of the issue, and any relevant evidence.
Sabarat will acknowledge receipt and work to investigate and resolve complaints fairly and within a reasonable time.
15. Limitation of liability
To the fullest extent permitted by applicable Moroccan law:
- Sabarat provides the marketplace and booking facilitation services, not the experiences themselves.
- Sabarat is not liable for the acts, omissions, conduct, or equipment of Operators.
- Sabarat does not guarantee that every experience will occur as scheduled, that weather will permit an activity, or that all listing details are free from error.
- Sabarat's total liability to a customer for a claim arising from these Terms or the Services is limited to the amount actually paid by the customer for the relevant booking.
- Sabarat is not liable for indirect, consequential, incidental, or punitive damages, loss of enjoyment, or travel costs not included in the booking, to the extent such exclusion is permitted by law.
These limitations do not apply to liability that cannot lawfully be excluded, including liability for fraud, personal injury caused by negligence, or any other mandatory statutory protection.
16. Indemnification
You agree to indemnify and hold harmless Sabarat and its officers, directors, employees, agents, and partners from claims, damages, losses, costs, and liabilities (including reasonable legal fees) arising out of or connected with:
- your use of the Services;
- your breach of these Terms;
- false or misleading information you provide;
- your conduct during an experience; or
- your violation of applicable law or the rights of a third party.
17. Third-party services and links
The platform may contain links to or integrations with third-party websites or services. Sabarat does not control, endorse, or accept responsibility for third-party content or practices. You access third-party services at your own risk, subject to their own terms and privacy policies.
18. Privacy
Your use of the Services is subject to the Sabarat Privacy Policy. By using the Services, you acknowledge and accept how Sabarat collects, processes, and uses personal information as described in that policy.
19. Force majeure
Sabarat is not in breach of these Terms where it is prevented or delayed from performing an obligation by circumstances beyond its reasonable control, including acts of God, natural disasters, pandemic, epidemic, government action, civil unrest, strikes, or infrastructure failure. Sabarat will take reasonable steps to minimize disruption and communicate with affected customers.
20. Changes to the Services
Sabarat may modify, suspend, or discontinue a feature, listing, or part of the Services at any time. Where a confirmed booking is affected by a Sabarat-initiated change, Sabarat will offer a fair remedy consistent with the Refund and Cancellation Policy.
21. Changes to these Terms
Sabarat may update these Terms to reflect changes to the Services, legal obligations, payment features, or business operations.
The current version and effective date will be published on this page. Where required by law, material changes will be communicated through the website, email, or another appropriate method.
Continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms.
22. Termination
Sabarat may restrict or terminate your access to the Services:
- immediately, where there is evidence of serious misconduct, fraud, or a serious threat to safety or security;
- on reasonable notice, for other violations of these Terms; or
- at any time for other lawful reasons.
You may stop using the Services at any time.
Termination does not affect rights or obligations that arose before termination, including payment obligations, refund rights, or pending complaints.
23. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Morocco.
Sabarat and the customer will attempt to resolve any dispute arising from these Terms or the Services through good-faith communication and, where appropriate, through Sabarat's complaint process, before initiating formal proceedings.
Where formal proceedings are required, the competent courts of Morocco will have jurisdiction, to the extent permitted by applicable law.
Nothing in this clause prevents a customer from exercising a mandatory legal right available under applicable law.
24. Language
These Terms may be made available in several languages. The English version is the controlling version where translated versions conflict, to the extent permitted by applicable law.
Translations are provided as a courtesy and do not limit or reduce rights granted by mandatory law.
25. Severability
If a provision of these Terms is found to be unenforceable or invalid, it will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force.
26. Entire agreement
These Terms, together with the Privacy Policy, the Refund and Cancellation Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Sabarat regarding the Services and supersede all prior or contemporaneous agreements.
27. Partner and referral program
The Sabarat partner and referral program is subject to separate Partner/Referral Program Terms. Participation in the program is governed by those additional terms.
28. Operator agreement
Operators who list experiences on Sabarat are subject to a separate Operator agreement in addition to these Terms.
